These Terms of Service (“Terms”) are an agreement between you and AllAmericanHosting.com (“we”, “us”) covering the web hosting services, control panel and website at allamericanhosting.com (the “Services”). By creating an account or using the Services, you agree to these Terms, our Acceptable Use Policy, our Privacy Policy and, where it applies, our Service Level Agreement.
1. Your account
- You must be at least 18 and able to form a binding contract. If you sign up for a business, you confirm you’re authorized to bind it.
- Give us accurate contact and billing details and keep them current.
- You’re responsible for everything done through your account, including by people you invite. Keep your password safe and turn on two-factor authentication.
2. Plans, billing and renewal
- Plans are billed in advance, monthly or yearly, through our payment processor, Stripe. Prices are in U.S. dollars and exclude applicable taxes.
- Honest Price Pledge. Your subscription renews automatically at the same price you signed up at. If we change list prices, your price stays the same for as long as you remain on your plan without interruption.
- Promotional discounts apply as described in their own terms.
- If a payment fails, we’ll notify you and retry. Your sites keep running during a grace period (currently 7 days); after that the subscription may be suspended until payment is made. Suspended accounts keep their data for at least 30 days before termination.
- Changing plans takes effect right away, with the difference prorated by Stripe.
3. Money-back guarantee and cancellation
You can cancel at any time from the Billing page of your control panel. If you cancel within 30 days of your first payment, we’ll refund that payment in full. See the Refund Policy for details. After cancellation your sites keep running until the end of the period you paid for.
4. Your content
- You own your websites, files, databases and everything else you store with us (“Your Content”). You give us only the permissions we need to host, back up, secure and deliver it.
- You’re responsible for Your Content and for having the rights to publish it, and for complying with the laws that apply to your website and its visitors.
- You can download Your Content at any time while your account is active.
5. Acceptable use and resources
Your use must follow our Acceptable Use Policy. Each plan has CPU, memory, storage and other allocations enforced by the platform. Bandwidth is unmetered for normal websites. If a site threatens the stability or security of our network, we may throttle, isolate or suspend it, and we’ll tell you why.
6. Backups
We back up sites daily and keep backups for your plan’s retention period, but backups are a safety net, not a guarantee. Keep your own copies of anything you can’t afford to lose.
7. Suspension and termination
We may suspend or terminate Services for non-payment, for serious or repeated violations of these Terms or the Acceptable Use Policy, or when required by law. Except in emergencies or where the law prevents it, we’ll tell you first and give you a chance to fix the problem. After termination, data may be deleted following our retention periods.
8. Service availability
We work hard to keep the Services available and commit to the uptime described in our Service Level Agreement. Service credits under the SLA are your sole remedy for downtime.
9. Warranties and liability
Apart from the commitments in these Terms and the SLA, the Services are provided “as is”. To the extent the law allows, we disclaim implied warranties, and our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim. Neither of us is liable for indirect, incidental or consequential damages, or for lost profits or data.
10. Indemnity
You agree to defend and indemnify us against third-party claims arising from Your Content or your violation of these Terms or the law.
11. Changes
We may update these Terms. For material changes, we’ll give you at least 30 days’ notice by email. Changes never override the Honest Price Pledge for your current plan.
12. Governing law
These Terms are governed by the laws of the United States and the state in which we are organized, without regard to conflict-of-law rules.
